Rule breakdown

Use the rule only for the identified verification rows

The rule refers to section 265, table serial numbers 3 and 9. Read the applicable parent row and the entity’s circumstances before selecting the verifier.

It does not make every external adviser a permitted substitute for the usual authorised signatory.

Formal appointment and role matter

The person must be appointed by the Adjudicating Authority for duties and functions as an interim resolution professional, resolution professional or liquidator under the Insolvency and Bankruptcy Code and related rules and regulations.

Retain the appointment order and confirm the relevant role and period when the return is verified.

Read the defined authority and current filing requirements

The rule imports the Adjudicating Authority meaning from section 5(1) of the Insolvency and Bankruptcy Code. Use the appointment and current tax-filing requirements to establish authority for the particular return.

A professional’s qualification alone is not the appointment required by this provision.
