Statutory text
Bare law
Notwithstanding anything contained in this Act or any other law for the time being in force, where any supply is made for a consideration, every person who is liable to pay tax for such supply shall prominently indicate in all documents relating to assessment, tax invoice and other like documents, the amount of tax which shall form part of the price at which such supply is made.
Introduction
This is a tax-disclosure obligation for a person liable to pay tax. It works alongside section 31's document requirements and section 32's ban on unauthorised tax collection.
Key takeaways
Show the tax amount prominently
Where the section applies, the tax amount forming part of the price must be clear on the tax invoice and similar documents.
The liable person is responsible
The duty attaches to the person liable to pay tax for the supply made for consideration.
Use the correct tax treatment first
Confirm whether the supply and document actually call for CGST before displaying an amount as tax.
Determine tax liability
Classify the supply and determine the liable person under the charging and reverse-charge provisions. Section 33 applies to a supply for consideration where that person is liable to pay tax.
Present the tax amount
Check tax invoices, assessment documents and like documents for a prominent amount of tax that forms part of the price. Use current invoice Rules for required document particulars.
Reconcile billing and returns
Compare the tax shown on documents with the rate and amount reported in returns. Resolve mismatch using the applicable correction rules rather than silently changing the displayed amount.
Practical checklist
Do
- Prominently show the applicable tax amount on covered documents.
- Reconcile displayed tax with return data.
Avoid
- Hide a tax amount in an ambiguous price line where disclosure is required.
- Display CGST on an exempt or otherwise non-taxable supply without legal basis.
Frequently asked questions
Does section 33 require tax disclosure beyond the tax invoice?
