Introduction

This is the central return-filing provision. Ordinary registered persons report supplies, ITC and tax; distinct subsections deal with composition taxpayers, TDS deductors, Input Service Distributors and non-residents.

Key takeaways

1

Select the correct return class

The ordinary registered person files monthly unless a notified class qualifies for quarterly filing. Composition taxpayers file an annual return; TDS deductors, ISDs and non-residents have distinct return obligations.

2

Payment and nil periods

Tax due under an ordinary return is generally paid by its filing deadline. Monthly payment arrangements for quarterly filers and composition taxpayers depend on the prescribed method. Ordinary and composition returns are required for each tax period even without supplies.

3

Correcting an error

Qualifying omissions or incorrect particulars are rectified in the prescribed form and manner, subject to interest. The normal correction cutoff is 30 November following the relevant financial year or actual furnishing of the annual return, whichever is earlier.

4

Sequence and three-year bar

Previous-period returns or section 37 details for the period may block filing, subject to notified relief. A return ordinarily cannot be furnished more than three years after its due date, with a power to notify exceptions.

Practical checklist

Do

  • Identify the registration category before choosing a return.
  • Reconcile outward supplies, ITC, tax paid and cash or credit ledgers.
  • Check current prescribed due dates and any extension for that class.
  • Track rectification and three-year outer limits.

Avoid

  • Rely on an old portal deadline without checking current Rules and notifications.

Frequently asked questions

Can an ordinary registered person skip a nil tax period?

No. Section 39(8) requires a return for each tax period under subsections (1) or (2), even when no supplies were made.
