Understanding GST Penalties

GST penalties are financial penalties imposed for violations of the GST Act, 2017 and its rules. Penalties are separate from late fees (filing delays) and interest (late payment of tax). Three key provisions govern GST penalties:

Section 73 applies when a taxpayer fails to pay tax due to any reason other than fraud or willful misstatement. The penalty is 10% of the tax amount (minimum Rs. 10,000). This covers genuine errors, late discovery of liability, and correctable mistakes.

Section 74 applies when tax is evaded by fraud, collusion, or willful misstatement - for example, fake invoices, wrong ITC claims with intent, or suppression of facts. The penalty is 100% of the tax amount. This is the most serious category and can trigger prosecution under Section 132.

Section 122 is the general penalty provision covering violations such as failure to obtain GST registration, violation of E-way bill rules, incorrect invoicing, failure to deduct TDS/TCS, and more. The quantum ranges from Rs. 10,000 to Rs. 25,000 or the tax amount involved, whichever is higher.

Interest under Section 50 is charged at 18% per annum on unpaid tax from the day after the due date. This applies regardless of intent. Interest is calculated on the net cash liability (output tax minus ITC utilized).
