Terms of Service

These terms are the agreement between you and Postyai for using our AI email-marketing platform. In short: you bring your own data, sending accounts, and API keys, and you use Postyai to write, send, and follow up on email at your own direction. By creating an account or using the service, you agree to the terms below.
1. Acceptable use
Postyai is for legitimate, permission-based outreach. You agree not to use the service to send unlawful, deceptive, or unsolicited email without a lawful basis, and not to send spam, phishing, malware, or content that infringes someone else’s rights.
- Only email contacts you have a legitimate reason and lawful basis to contact.
- Honour unsubscribe and opt-out requests, and keep your lists clean.
- Do not use Postyai for harassment, fraud, or any activity prohibited by applicable law.
- Do not attempt to bypass sending limits, warm-up safeguards, or platform security.
We may suspend accounts that put deliverability, other users, or the platform at risk while we investigate.
2. Your credentials and accounts
Postyai is bring-your-own-everything. You are responsible for the email/Gmail/SMTP accounts, LLM API keys, and any proxies you connect, including keeping them in good standing, paying their providers, and complying with those providers’ terms. You are responsible for all activity under your Postyai account and for keeping your login secure. Charges you incur with your own model, email, or proxy providers are yours to pay directly to them.
3. Your data stays yours
You own the contacts you upload and the content you create with Postyai. We act as your processor for that data, as described in our Privacy Policy. You warrant that you have the right to upload and email the contacts in your lists.
4. Service provided “as is”
We work hard to keep Postyai reliable, but the service is provided “as is” and “as available,” without warranties of any kind. Email deliverability, inbox placement, and reply rates depend on factors outside our control — including your own sending accounts, list quality, and third-party providers — so we cannot guarantee specific results.
5. Limitation of liability
To the maximum extent permitted by law, Postyai is not liable for indirect, incidental, or consequential damages, or for lost profits, data, or goodwill arising from your use of the service. Our total liability for any claim is limited to the amount you paid us for the service in the three months before the claim arose.
6. Billing
Paid plans are billed in Indian Rupees (₹) on the cycle shown at checkout. Fees are for access to the Postyai platform only; the cost of running your own model API, email accounts, and proxies is separate and billed to you by those providers. Unless stated otherwise, fees are non-refundable, and you can cancel to stop future charges. See Pricing for current plans.
7. Termination
You can close your account at any time. We may suspend or terminate access if you breach these terms, put the platform or other users at risk, or use the service unlawfully. On termination, your right to use Postyai ends and we handle your data as described in the Privacy Policy.
8. Changes to these terms
We may update these terms as the product evolves. If we make a material change, we will update the date above and, where appropriate, notify you. Continuing to use Postyai after a change means you accept the updated terms.
9. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
